Equipment

 

You must purchase at at least one incubator (preferably two) with a temperature capability of 20-40˚C (68-104˚F), and an analytical balance (“scale”) accurate to 0.1 grams, prior to your initial testing. You may also need to purchase a mortar and pestle, depending upon the physical nature of your product or material. A very inexpensive incubator (less than $200) can be purchased here. An analytical balance and a mortar and pestle can be purchased at any major retailer or online for very little cost. These are one-time costs!  You can use this equipment indefinitely for future testing.

EB Test

 

The EB test is what is termed “quantitative”. This means that the test result provides you with the number of microorganisms in your product (e.g., per gram), like AC and YM. Quantitative tests have a “sensitivity”. This means that the test has a limited capability of providing you with the actual number of microorganisms in your product.  As with AC and YM, the EB test’s sensitivity is “10”. If no microorganisms grow with this test, your product may still have less than 10 Enterobacteriaceae (e.g., per gram or milliliter).

 

Your State’s laboratory may use a different kind of test termed “qualitative”. Essentially, this means the laboratory’s test will theoretically tell them if any Enterobacteriaceae (or any of the specific microorganisms in the group) are present or not present. If your product has less than 10 of these microorganisms per gram or milliliter, it’s possible that your State’s laboratory may still find that your product contains these. However, based upon the extensive experience of CannaQuality’s expert Microbiologist, in most cases a product is either “clean” or grossly contaminated. You must exercise your best judgment!

Your CannaQuality Test Kit is not intended to replace testing or refute results reported by your State’s official, certified, approved, qualified, etc. testing laboratory. Results obtained by your company using your CannaQuality Test Kit are for “screening” purposes only. The purpose of screening is to afford you the opportunity to determine the probable microbiological quality of your product prior to testing by your State’s laboratory.

 

You must store your CannaQuality Test Kit as prescribed in the Instructions Booklet. If you do not store it as prescribed, your test results may be flawed.

 

Your CannaQuality Test Kit is not designed to test for such specific microorganisms as Staphylococcus aureus, Pseudomonas, Enterococcus, Clostridium, etc. Note that any organisms recovered from this testing cannot be removed and identified.

 

Your company assumes full responsibility for following the instructions and guidelines presented in the Instructions Booklet.

This product is warranted by CanaQuality only against defective workmanship or materials. All other warranties, whether expressed or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose, are hereby disclaimed. There is no warranty of any kind whatsoever on the accuracy of the results reported by CannaQuality, including anyone working for or through CannaQuality.

 

Liability is limited solely to the replacement of the CannaQuality test kit, or refund of the purchase price, at the sole discretion of CannaQuality.  By purchasing or using this product, you agree that CanaQuality (including, without limitation, anyone working for or through CannaQuality) will not be liable for any expenses, loss or damage whether incidental, consequential or direct in connection with the sale or use of, or inability to use, the product for any purpose, or for any inaccuracy in the reported results or for any failure to report results, or for any breach of the warranty.

 

The above disclaimers and limitations may not be altered, except in a writing by CannaQuality that specifically identifies the disclaimer or warranty being altered and states, unambiguously, that it is CannaQuality’s intent to alter the disclaimer or limitation.  Without said unambiguous statement, no writing will be interpreted to have the effect of altering the above disclaimers and limitations.

 

Any buyer or user of this product hereby waives the benefit of any rule that would have the effect of the above limitations and disclaimers being construed against CannaQuality.  Any buyer or user of this product hereby agrees that the foregoing limitations and disclaimers shall be construed liberally in favor of CannaQuality, including anyone working for or through CannaQuality. Nothing in the above provisions shall be interpreted to create any warranty on the part of anyone working for or through CannaQuality, any such suggestion of a warranty being expressly disclaimed.

 

Arbitration / Choice of Law / Venue

 

In the sole discretion of CannaQuality, any dispute related to the CannaQuality Test Kit, and/or the reporting or non-reporting of results related to the CannaQuality Test Kit, shall be submitted to arbitration pursuant to the rules of the American Arbitration Association (or other mutually agreed to forum for arbitration).  The buyer/user acknowledges that they are waiving their right to have their dispute adjudicated in court by a judge or jury.  Any such dispute will be venued in Bucks County, Pennsylvania, applying Pennsylvania law.
